Acceptance of Terms

By booking with KenyaOnABudgetSafaris, you agree to these Terms & Conditions, which apply to all bookings, payments, cancellations, and related services. Please read carefully.

Bookings & Payment

  • Bookings are only confirmed once we have accepted them in writing (email/WhatsApp).
  • A deposit or full payment may be required.
  • Until payment is received and confirmation sent, availability is not guaranteed.

Pricing & Changes

  • Prices are quoted in KES or GBP.
  • Prices include only the services stated at the time of booking.
  • Rates may change due to supplier updates, exchange rates, or tax adjustments.
  • Any material changes will be communicated before final confirmation.

Cancellations & Refunds

Cancellations are governed by our separate Refunds, Cancellations & Payments Policy (effective date: 29/01/2025), which forms part of these Terms. Please review it for refund tiers and non-refundable items.

Supplements & Extra Costs

Extra costs may apply for:

  • Optional upgrades
  • Special permits
  • Fuel surcharges
  • Unplanned events

These will be communicated in advance and invoiced separately.

Health & Safety

  • Clients are responsible for their health requirements (vaccinations, insurance, permits).
  • Evidence may be required for certain activities.
  • We assist in emergencies but are not liable for illness, injury, or service disruption.

Liability

  • We act as an agent for suppliers and are not liable for loss, injury, or damage unless caused by proven negligence on our part.
  • Supplier terms and local laws apply.
  • Our liability is capped at the total amount paid to us for the affected services.

Force Majeure

We are not responsible for delays or cancellations caused by events beyond our control (e.g., natural disasters, government action, unrest, supplier insolvency). Where possible, we will help rebook or refund according to supplier policies.

Client Conduct

  • Clients must respect wildlife, local communities, guides, and Kenyan law.
  • Unsafe, unlawful, or disrespectful behaviour may result in termination of services without refund.

Privacy

Your data will be handled in line with our Privacy Policy (effective 29/01/2025).

Payment Processors

We use trusted third-party payment providers:

  • Stripe
  • Safaricom M-Pesa
  • Business bank transfer

We do not store full card details.

Governing Law

These Terms are governed by the laws of Kenya. Any disputes will be resolved by the courts of Kenya.

Updates

We may amend these Terms from time to time. Updated versions take effect when posted on our website. For significant changes, we will notify you directly if they affect an active booking.
